Currently, the law considers social media to be âplatformsâ, and they cannot be held liable for any defamatory or harassing content by their users.
This executive order changes that, and reclassifies them as being âpublishersâ. The rationale behind this is that they select which content to display by censoring content they donât like, so they are more of a curator/publisher than a platform. As a âpublisherâ they are legally liable for content posted on their sites.
In order to be considered a âplatformâ and continue to enjoy their protections, they cannot censor people anymore.
This will give them a strong incentive to stop censoring.
