The biggest problem the 9th had was with the lack of Due Process

The best part about this whole deal is that the Bush administration actually pulled off exactly what Donald wanted to do with US-VISIT, which collected biometric information on all non-citizens, and applied "extreme vetting" (i.e. racial profiling) to those persons entering the country from areas known for Islamic terrorism. Although the Bush administration did away with profiling in 2003 (vetting everyone instead of specific social groups), DHS got ade facto exemption and was still doing it up until 2014.
So clearly it could have been done, just needed some sort of moral and legal justification, and to cloak it in language exclusively referring to security risks, not religion.
Instead, Donald invented a non-existent problem (Iranian terrorists killing Americans), proposed a solution using unconstitutional language, and than got slapped down by the courts - literally too stupid to carry out his own agenda.
