Purposefully keeping people "employed" in unpaid positions as a feeble attempt to prevent the cost of covering unemployment is similarly bad. Plus paying people under the table, presumably to avoid paying payroll taxes. With recorded evidence.
hey vice journalist, we got this juicy audio and we need you to pick a really good quote that we can highlight in bold font right below the audio box... oh i know
“I’m on the phone, but I can barely hear you all because of this fucking hum.” —Ja Rule
"We're not going to fire you or lay you off or pay you. I'm just going to do some more coke and then probably some more coke and that's pretty much the whole plan at this point."
"Last Friday, Billy McFarland, the 25-year-old founder of the disastrous Fyre Festival, told his shell-shocked employees that their paychecks covering the past two weeks would not be coming. Nor would he be firing them, a prerequisite for unemployment benefits in most states. Instead, McFarland offered to let his dozen-or-so employees stay on in unpaid roles, where they could work to grow the business to a place where they might get paid again."

Wow, that's like "it'll look good on your portfolio!" taken to its natural conclusion. Except most people won't even be able to list working for him on their resume because of what a disaster it was.
Haha. At least the people who paid money got some shitty sandwiches and tents. I bet the people working it had to sleep in the sand and eat only what they could catch.

Well, first of all, he can't "not pay them". It's not an optional thing. He has to pay them to every last cent and if he doesn't, he is gonna get so arsefucked you would think it was a casual /r/drama's regular Saturday night.
Second, I am not 100% on the US specifics, but reducing the wage dramatically usually counts as constructive dismissal in most of the civilized world. In essence, your working conditions were so changed that it's like having a new job.
Third and final, you can't have them work for free legally. Doesn't this fucking guy have a lawyer or an accountant or someone who wasn't hit in the head with a brick repeatedly when he was a newborn? You HAVE to pay people to work at least minimum wage. Interns can be unpaid because (theoretically) they do no work to support the company.
Yeah. I think in the US tipping professions/service professions have a lower minimum wage (for whatever fucking reason) but they have to be paid that minimum wage.
It can make your unemployment tax rate go up. Either case, this guy should've talked to a lawyer - saying, "I'm not firing you, but I'm not paying you" doesn't stop your employees from quitting filing for unemployment.

You don't pay your employees, as a director and executive officer, that's personal liability. Bankrupting the company won't even make that go away.
