not everyone has the indefinite financial stability to look around for a position that is appropriate for them and doesn't violate their privacy. being out of work is a desperate situation for many people, and they can't necessarily take the time to stand up for their rights when that might mean not being able to make rent and ending up on the street. if that doesn't seen like an issue to you, fine, but don't hide your indifference behind some laughable illusion of "choice" like we're talking about shopping in a fucking supermarket here.
Oh wouldn't you know, it's the HIPAA privacy officer here showing us his badge. I'm sooooo scared, what are you going to do, arrest me?
Oh wait! You're just a HIPAA security guard LMAO not even the real HIPAA police who can sue me for a large amount of money and then I can settle out of court for an unspecified amount of money that is a fraction of the original charge since NIH knows bankrupting medical organizations who by and large can't comply for shit would cause a public health crisis
Holy Slippery Slope Fallacy Batman! Apparently Gay Marraige leading to Polygamy is a ridiculous argument, but volutarily releasing information on murder auromatically leads to discrimination based on extra nipples!

She's right, you know.
I work in HIPAA compliance, this has to be waiver'd before a hospital can disclose.

If you are out of work and want to be hired, you'll waiver it.

Which is exactly why this law is fine. People have a choice, just like they do with drug testing.

That's odd, I came to the exact OPPOSITE conclusion from the exact same statement.

How so? Not every company that can (by law) drug test, will drug test. I expect this law to be implemented in a similar fashion.
People will have a choice. If they don't want to work for a company that requests that you waive your HIPPA rights they won't have to.

But it's not a "illusion" of choice, it's actual choice. Work at job A or not.
Their "desperate situation" does not affect their ability to make that choice.

When it's a matter of having food or not, it's not a matter of choice.

mduell pretty much sums up TwoX's usual confusion with regard to HIPAA's relevance here:
