that's perfectly reasonable, the objection i have is mostly with how he was charged, not with the usage of tear gas or with his being charged at all. i mean, there are objections i have on a more abstract level to those things, but they're beside the point. within the current paradigm, using tear gas on that sort of protest or arresting someone who kicks the tear gas back are not worth getting upset about. what is worth getting upset about, imo, is charging that person with a felony. a misdemeanor, some other minor charge? fine, whatever. it happens, everyone knows it happens. but a felony is potentially life-ruining, with how felons are treated in our society, and that feels both incredibly disproportionate to the act, and incredibly chilling to political action in general. if people start associating "going to a protest" with "being charged with a felony" (the direction i predict the narrative will go, and the direction i suspect the police would prefer it go, regardless of its actual particulars) then people are gonna be a lot less willing to go to a protest, and i think that is incredibly damaging and dangerous for our society.

of course, as other people have speculated, they probably don't expect the felony to stick, and are just using it to force a plea deal, which is an entirely separate and arguably more important criminal justice issue.

When you put it that way, yeah it sounds bad. But the context missing is that some of the protesters had been throwing rocks, bottles, and other things and started becoming violent. It's happened at peaceful protests before, and the peaceful protesters usually disperse and leave the violent ones to be arrested, get gassed, whatever they bring on themselves. By kicking it back and refusing to just leave, he became a non peaceful protester.

We had a protest here in my city for BLM. The peaceful protesters did what they do for a couple of hours. When the punks started damaging things and attacking people, the peaceful protesters dispersed and watched from the sidelines. The cops spent the entire night rounding up and arresting the violent ones. Even the peaceful protesters came out against the actions of the violent.

What he did would be no different from him taking the rubber bullets shot at him and using a gun to shoot them back at the cops. They used the tear gas in an attempt to disperse the assholes and he is facing the consequences of being one of those assholes.
