I looked it up. Its very vague regarding if schools can punish you for speech outside of school. Also the supreme court has not taken up any of the cases that have been related to the digital playground so there is no defining ruling.
Apparently while protected under the first amendment, if the speech is considered bullying it floats into more grey areas.
So when it comes down to it, nobody knows! There have been a few cases of this happening where students get suspended or expelled for racial slurs on social media. Some school lawyers also recommend to error on the side of stopping bullying as first amendment lawsuits typically don't pay out as much as bullying lawsuits

It's a public school, the general idea is that if you don't try to kill someone you should be able to attend.

My guess would be that since, another student was concerned then it could constitute cyber bullying.

I can imagine that the parents could pull a lawsuit off since he didn't do anything racist or illegal.

School lawyers would argue he is bullying and intimidating his fellow students

They'd have to find an equally retarded MAGActivist judge to even get a fighting chance against the school.

There will be a lawsuit, and they’ll settle out of court.
