The fact that someone is man or woman is a far more accurate predictor of crash probability than driving record, especially if the driver is young and has very little driving history.

They're doing it based on the available statistics. If being a man is a statistical indicator that you're going to do something stupid on the road, then it is merit-based. Perhaps we as a society, however, should agree that we would rather people pay more overall in exchange for ignoring certain factors that we find distasteful to consider, such as gender and race. Banks are no longer allowed to consider zip code when giving out loans, not because people from certain areas don't legitimately pay back loans at a different rate than other areas, but because America has racially segregated neighborhoods.
