No; In recognition of the aids epidemic's decline it's been downgraded to a misdemeanor, to be in line with the punishments for giving someone other dangerous infectious diseases, like anthrax, intentionally. However, like giving someone anthrax counts as attempted murder, you can sue very easilly for giving you HIV in the courts.
Why should you have to sue someone for purposefully giving you an incredibly serious life long disease? It really seems like it should be a felony. Same thing for anthrax.
