Lmao imagine being so humorless that not only do you not understand certain types of humor, but you actively seek and destroy humor elsewhere that you don't understand. src
It’s mainly the damages. Can the diver show Muskrat financially damaged him?
I’m mildly interested in this case and surprised they’re not suing Twatter for the bonus round. It facilitated Musk’s statements, has a history of policing troublesome speech (see bans/suspensions), and didn’t act after Musk started this shit show.
In CA it's codified for slander, but not libel, which has its own more expansive definition. As I understand it, those codified categories of per se defamation are all applied to libel as well by common law, but the statute for libel per se basically encompasses everything that's defamatory on its face. It's one of those "we'll know it when we see it" rules.
This is much more straightforward in other states, CA is just kind of weird about it.
Fair points. I’ll be the first to happily admit I don’t touch defamation/slander cases and law school is so far back in the weeds I can barely recall the main points.
That certainly makes sense, considering defamation cases are pretty much always dogshit for anything other than publicity. There are those rare cases of corporate defamation that can result in huge awards, but those are like unicorns.
People are talking about all the money coming this guy's way, and I don't buy that for a second.
Precisely. Hence my reference to damages. I’m willing to bet he’ll get the infamous dollar bill. Or Musky bending the knee and apologizing. I just can’t see a lot of money in this.
From a verdict, sure. But they could get substantially more from a settlement in exchange for avoiding a public apology and burying the whole thing under a mountain of NDAs.
Keep in mind that part of this settlement will almost certainly be a very public, extremely contrite apology from Musk. He's going to get a massive public shaming because of this. Again.
Almost the opposite, you'd expect that if the claim were even slightly legit (which it is) that Musk would settle. But the diver might (might) actually be a functioning human being who doesn't want to spend their life dealing with twitter bullshit.
A lot of Musks's wealth is tied up in the companies he owns. No way he's giving up control over any of them for a potentially lengthy and costly legal battle. I would wager it gets settled quickly, Elon will be forced to delete tweets, he may or may not be forced to apologize in some fashion, and then it'll go down our collective memory holes soon enough since retarded bullshit happens everyday and it's hard to keep up or care about 99% of the shit going on.

That entire subreddit is a cesspool. It's like a sewer that empties directly into a stagnant pond.

I'm not a legal expert, but wouldn't it be inadvisable to sue someone with a net worth of $20 billion unless it was an obvious slam dunk?
1 rationalhuckleberry 2018-08-29
Ehhhh.
He got Lin. If I was going to sue someone, that guy is pretty good with defamation claims.
I give this a 10% chance of Space Daddy losing in court, 89% chance of a settlement with apology, 1% Space Daddy prevailing.

Unless this guys lawyers show up drunk idk how this guy loses. This is practically a textbook case of libel

This would be defamation per se. Damages are assumed insofar that they're an element of the cause of action.
This accusation could fit under crimes of moral turpitude, sexual impropriety, or what I think is the strongest argument, loathsome disease.
1 rationalhuckleberry 2018-08-29
Do we still have loathsome disease on the books?

It won't cost Unsworth a cent, and this is going to get settled ASAP. They (Tesla's board, especially) want this out of the press.
1 Snakeyez 2018-08-29
When you put it that way. Settling it is going to be like swatting a mosquito in terms of how much it will hurt Elon financially.

No matter what it's free, I think lots of lawyers would take it to trial on contingency.
