Until around 1950 the Soviet Union would occasionally "abolish" the death penalty for a few months, a year, or so, but then changed its mind and pick up where it left off. Because the "abolition" of the death penalty was not retroactive, and they started back executing people who's sentence had been passed before the "abolition", this was really more like a glorified moratorium than an actual death penalty abolition. After 1950 they basically stopped the shit, forever stopped pretending to even care about all of those promises they'd made on that lofty pre-1917 political platform.

Believing in due process /= wishing to abolish law
Visas did not exist at the time the constitution was written, or when the 14th amendment was written, nearly all constitutional rights (except those explicitly granted to "citizens" - mostly voting rights) apply to all people present in the US, and the visa - which was only ever introduced in the WWI era along with a lot of other big government reforms - is not some magical document who's presence or absence has the power to render a person a constitutional unperson. It could not, because the constitution never mentions it, and the legislature has no power to pass any law the constitution doesn't give it the power to pass, so clearly it cannot pass a law (like an immigration and visa law) which requires a person to have a visa or birth certificate and otherwise means they have no rights under the constitution. The law can give the government the right to remove said person for said violation, it cannot give the government the power to do so without respect to normal constitutional rights.
