He can and will veto this. It's just a power move by Congress to openly defy the President and it does look bad for him that 12 Republicans voted against him, but it won't change anything.
I'm pretty sure there are already court cases about this emergency order. This is just Congress telling the president that they don't approve of the emergency order. As preserved_fish said, it may affect court battles, but this dispute between Congress and the president doesn't directly go to the courts.
