What the law should or shouldn't do doesn't really matter, only what it does do. Whether your speech is protected rests on three elements, intent, imminence, and likelihood.
Imminence is actually where most attempts to punish speech fall short. Which is why this specific incidence is such a great example. She knew exactly what he was doing, she urged him to do it, she knew he was in process of doing it, and when he stopped momentarily, she urged him to continue doing it. She had intent for him to do it, knew he was likely to do it, and knew he was going to do it now.
Honestly her lawyer did defend her intelligently, but it was a high risk move. He argued technicalities, and waived the jury trial in favor of the bench trial, which is what you want to do when arguing technicalities.
However when the prosecutor brought the manslaughter charge instead of trying to bullshit his way into some form of assisting a suicide (what the defense attorney was rightfully pointing out doesn't exist in MA), I think he should've went for a diminished capacity defense ("insanity").
All the prosecutor needs to prove to support his charge is:
1) That the defendant intended that the specific death in question result from his or her actions, and
2) That the defendant’s conduct rose to the level of “reckless disregard” for the defendant’s life.
To which I would point out, even in some bizarre world where she was "calling a bluff" (which, once more, given telling him to get back into the car is bananas), she definitely showed a reckless disregard for the consequences of her actions.
But I mean this is Monday morning quarterbacking. "Oh you should've thrown the ball to that guy dummy, duh" it is a bit different to judge after the fact.
Except for the idiots in the linked thread, they are just absolute morons.
It absolutely should. This foidess is an awful creature, but telling someone to keep themselves safe is protected speech. Imminent lawless action is the standard and there's nothing unlawful about an adult taking the Beltway Express to Heaven.
It's been shown that women get lighter sentences than men for the same crimes but ya, I'm sure a male would get off in this case for no reason whatsoever.
