The case was probably argued as she was trying to swerve to prevent hitting the back of the bus. It’s a legal loophole because hitting the back of the bus puts her at fault, but it’s not a criminal offense to attempt to avoid an accident in a reasonable manner.

Not necessarily. If you got cleared once, unless the new evidence actually changes anything, you're probably going to get cleared again. The family is just trying to get the woman in jail, so it's entirely possible that the new evidence wasn't particularly damning.

You don’t argue before a grand jury, they work for the state and only interact with prosecutors and witnesses. Defendants aren’t present, don’t get to present a case, and frequently aren’t even allowed to know the proceedings are happening.

A grand jury recommended not pressing charges, twice. I think there’s stuff we don’t know or those technicalities are stronger than they sound - prosecutors don’t just pass on what look like slam dunk cases like this unless they know they’ll lose.
