I addressed that. I also addressed why that isn't a legitimate business reason for disciplining or terminating the employee over an aspect of the employee's life that is rightfully outside the employer's concern.
So, to reiterate: an employer doesn't have a legitimate business interest in dictating whether their employee is male, female, or otherwise;
Anglo, Japanese, Latinx, Malay, or otherwise;
25, 45, 55, or otherwise;
Titled Mr., Ms., Mrs., Reverend, Mx. Or otherwise;
Catholic, Protestant, Buddhist, or otherwise —
If their job is accomplished as any other employee's is, and the Loss of Business is solely ascribable to customers being persecutorial bigots, that then is not the fault nor responsibility of the employee.
Any suggestion that it is otherwise needs additional facts to bear that assertion out, or is (as history and the law have shown) simply wrong.
Any business chartered under the law which finds itself unable to operate in accordance with the law needs to reconsider whether it has failed or fulfilled its charter.
