I mean it's because it doesn't really make sense. That's why batman generally kills his villains in the movies and other adaptations. Like realistically you're not gonna let the joker go to prison or whatever, he's poisoned half of gotham, murdered thousands, etc. If the law worked half the villains'd just get the electric chair if I'm being honest.
Realistically the villains would just go to jail after one crime and stay there for 20 years or whatever the same as most violent criminals now, criminals in real life don't mastermind prison breaks and go on renewed killing sprees. If they did they wouldn't even need to be killed by Batman because they'd just get gunned down by the cops.

I mean the "actual" reason is that if superheroes existed they'd be an arm of or seen as being part of law enforcement i.e. the executive. The actual judgement of crimes and dealing of punishment would be, as is now, left to the courts as you wouldn't want people murking criminals extralegally no matter how justified. The real question is why is the Joker never executed for his crimes by the courts or, presuming that the death penalty is outlawed where Gotham is, why has no one cleaned him out ala Lee Harvey Oswald while in custody?
Irl it's technically considered cruel and unusual to execute the mentality ill. And there are lots of people we deem to ill for trial even. Back when my wife was still in school she had to do rounds in a asylum that housed murders and shit, basically none had even had a trial. If they were ever deemed mentally competent they'd then finally go to trial.
So I'm guessing in the Batman universe the Joker probably hasn't actually even been convicted of anything.

I really don't think there's really a whole lot of mature entertainment. It's usually just children's entertainment but with blood, swearing, and sexual innuendo
Imo the truly mature stuff is primarily nonfiction. Nothing wrong with fiction but outside of some old movies you're not going to find a lot of R-rated fiction that isn't just as childish as comics.
