Normally, uhh, yeah, but historically, in representatitive republics with these 3 branches: a state of exception or emergency makes prior rulings are irrelevant. What matters is is loyalty and hegemony.
Trump has loyalty and Hegemony, only thing he needs is a state of exception/emergency and the SC will play ball.
A state of emergency doesn't change judicial precedent, emergency powers allow the President to suspend due process but this would not be wise given that only like 19% support deporting DACA recipients and most just want the people who just arrived and criminals to be sent back. In any case, congress can end it. The Alien Enemies Act allows Japanese roundups, but, no real military invasion or incursion by a foreign government is occurring in the United States, so it would be unlawful to invoke the Act and would have Jap interment repercussions times 10
Also we know how shit like this plays out, the public is fickle an support dries up when shit doesn't work like they planned.
