It's the is/ought distinction. Freedom lovers who believe in the concept of free speech believe that it should protect your speech from being silenced by anyone - whether corporations, governments, religion, or individuals. Evil fascists who hate free speech (like the writer of XKCD) use the "rules as written" interpretation to point out that acktually sweaty, the way the Founding Fathers wrote free speech only offers protection from government censorship. Yeah, no shit, that's because there were no megacorps around back in those days so the Founding Fathers had no way of knowing how oppressive corporate power would become. It's usually easy to tell whether somebody is a heroic freedom lover or a worthless piece of shit based on how they define "freedom of speech."

Now to be fair, I don't believe in total freedom of speech. Like if the U.S. has an undercover agent operating overseas and you publish their identity online, that would get them killed and obviously you shouldn't do that. Or if you know how to build a nuclear weapon using common kitchen ingredients, that's probably a bad thing to retweet and share. But in general, the few things that deserve censorship are so transparently obvious and self-evident that even dedicated free speech activists would say "OK, maybe let's make an exception for that one." Most of the people saying that "misinformation" needs to be stopped are just salty because the "misinformation" simply points out how evil and stupid our elites are, and obviously our elites can't have people pointing out their failings because then there might be some big changes which result in them no longer being at the top of society anymore.

First, reframing "freedom of speech" as "freedom to listen" produces a much better attack surface, in terms of what you really want to defend, whose freedom you want to defend, and who you don't want to defend at all (for example, people spamming BIPOCcute twink in a discussion you're interested in are abusing your freedom to listen and should not be protected). I'm sure you can reconstruct the rest of the concept just from its name.

Second, all this stuff about misinformation makes me think that even such reframing is not enough and we must admit that democracy itself is not viable. Like, if given a freedom to listen too many voters would rather listen to lies, then this regime is not viable, and if we appoint the NYT as the arbiter of what voters can listen to then this regime is not a democracy.
