I think a lawyer might argue that having airdrop settings set up so that anyone near you can send you anything and also choosing to accept the request implies consent. If you sent me a picture of your bussy in a reply to this comment, would it be illegal? Probably not. The one child on the plane who could have potentially received it chose not to accept the request. I don't care if this dude goes to jail for this, just saying that a good lawyer might be able to get him out of it.
