It's like if there's a stadium filled with people. Maybe 100 people there are actually fascists. Maybe you can identify 20 or 30 of them if they open their mouths. Unfortunately, your false-positive rate means that you also label another 300 or 400 people as fascists, and you advocate violence against all of them.

That's where we disagree. The court differentiates between political speech and non-political speech, and even if they were to defend the above as political speech, just like aborted fetuses, I'd disagree, and there is no philosophical correct answer there, so we have to defer to pragmatism, and for me it's much sensible to ban such speech publicly. Anyway, to answer your question, in America your example would already be covered by the fighting words exception to the first amendment, so there is no need for additional laws. Shouting nigger at a black man would not be protected, saying "go back to Africa nigger" as in your example, would be protected in a public speech if not directed at an individual specifically to draw a violent reaction. People have the right to advocate any ridiculous or hateful political theories they want publicly, but there is a narrow exception for your specific example, and it doesn't require a law specifically based on race

I think a man shouting "All the niggers should go back to Africa" should not be protected if only because of the public use of the slur. The one thing I disagree with the court on wholeheartedly is that the definition of obscenity is only to do with prurient/sexual things, which I think is absurd- for example, I think mutilated aborted fetuses should not be able to be shown publicly as I don't consider it substantial political speech.
Anyway, my point is that it's a bit fallacious to appeal to the philosophical justification of people's rights but then cite a Supreme Court decision, since the latter pretty much confirms that there's no obvious philosophical answer to which speech should be protected and which speech the government can ban. I don't mind slurs and epithets, as well as gruesome pictures, just like porn, being banned publicly, and I think that's the most pragmatic and beneficial situation for society, and I don't think the philosophical defense of those behaviors is nearly strong enough.
