No, they don't contadict. You do realize that the verb "cannot" can be used in different ways? They're not saying that you literally can't do it (because people are) but that it's not right to do so. SPLC is saying that people are reducing Mexican culture to tacos, sombreros, piñatas, and other novelty items and then appropriating those legit but marginal parts of Mexican culture. But Mexican culture is much more diverse than these few things. Pretty much all examples of "cultural appropriation" involve oversimplifying a culture and then stealing the interesting bits.

Mexican culture can't be reduced to a few "novelty items" (are tacos novelty items?), but is rather a multifaceted set of unique beliefs, traditions, etc. So how are festivities that involve things the SPLC deems irrelevant or peripheral to authentic Mexican culture somehow cultural appropriation? I think the SPLC is trying to say that people going around acting like these things are the epitome Mexican culture are disrespecting the nuances of Mexican culture. I don't buy the argument, but I can follow the logic. The whole idea behind cultural appropriation involves instances like this where people pass off a few symbols as indicative of a whole culture.
