On the other hand, having them refuse to acknowledge the half dozen or so elephants in the room would have further eroded that faith, hastening the downfall of Canada and mankind as a whole. This would be better for drama, because not only would it piss everyone off, we'd get some nice consequences out of it to laugh at down the line.
The waxing procedure for a scrotum vs female genitalia is completely different anyway. Even if they were comfortable waxing Yaniv's balls, that doesn't mean they were *qualified* to. It's something you need to be trained specifically in what to do. They didn't have the qualifications to do it. It would be like asking your mechanic to bake a wedding cake.
Given her representation to various Respondents that she had “male parts”, has not “gone through surgery”, and “was born a man now I’m a woman”, the hearings initially proceeded on the understanding that she has a penis and scrotum, and that she was therefore requesting waxing of the scrotum. However, under cross examination she was evasive on the issue, referring to “whatever is down there”.

I find that Ms. Yaniv’s predominant motive in filing her waxing complaints is not to prevent or remedy alleged discrimination, but to target small businesses for personal financial gain. In many of these complaints, she is also motivated to punish racialized and immigrant women based on her perception that certain ethnic groups, namely South Asian and Asian communities, are “taking over” and advancing an agenda hostile to the interests of LGBTQ+ people. These motives are not consistent with the Code’s purposes. . .
This is a very polite and legal way of saying “get the fuck out of my courtroom, you racist grifter.”
In this decision, I analyse Ms. Yaniv’s complaints in two categories: genital waxing cases and cases involving arm and leg waxing. In the genital waxing cases, I find that scrotum waxing
was not a service customarily provided by the Respondents. As such, they did not deny Ms. Yaniv a service and did not discriminate against her. I dismiss these complaints under s. 37(1) of 4
the Code. In the leg and arm waxing cases, I find that Ms. Yaniv filed the complaints for improper purposes. I dismiss these complaints under s. 27(1)(e) of the Code.
In my view, the
most likely scenario is that Ms. Yaniv was trying to make Ms. Benipal feel uncomfortable or
awkward for her own amusement or as a form of revenge. This is consistent with Ms. Yaniv’s
behaviour in relation to all of the Respondents.

Ms. Yaniv has a grievance against certain ethnic and cultural groups in the lower mainland of BC which she perceives are failing to assimilate effectively into what she considers “Canadian” culture. These complaints are one way in which she is attempting to make this point and punish members of these groups.
On the bright side, I hear Metacanada is looking for new mods.
From some of the KF drama, it appears that Yaniv had the judge's phone number and email address, and at least at one point sent suicide threats to her after trying to be friends failed.
The suicide threats were a while back, sometime prior to the 'pretending to OD on weight loss drugs', and 'pretending to have brain cancer' sagas began.
I think it factored into some of of the decisions that were made.
Probably if it were a 'real' court. BCHRT seems to goals around progressiveness and mediation. They seem to want to be accessible and get people to settle. This is probably because the tribunal has no actual ability to directly enforce any of its decisions: the plaintiff has to get a favorable decision that falls into specific categories, then go to a real court and get them to enforce it. Also from reviewing the documents, it seems like the entire show is pretty much just the judge, so there's not really someone else to talk to about a case.
Fuck that award of costs. To each defendent no less.
While unfortunately, drama (and eroding the legitimacy of the BCHRT), would have been better served by by a decision in Yaniv's favor, I'm still going to have to dissect this whole thing for the sheer schadenfreude.
