In Texas I think you can get some form of DWI regardless of the substance in question. You do have to actually be intoxicated to be charged though. Like having a can of computer duster isn’t an offense.

Well it’s probably state dependent. I can say in my state the statute allows for DUI for anyone impaired by β€œdrugs” but drugs is not defined. So, yes if you take the things you mentioned and it impaired your ability to drive safely on the roadway and they were able to prove that in court you would be convicted.

Exact answer by jurisdiction:

I looked up NY: illegal to operate a vehicle:

1. ... while the person's ability to operate such motor vehicle is impaired by the consumption of alcohol.

2. ... while such person has .08 of one per centum or more by weight of alcohol in the person's blood as shown by chemical analysis ...

3. ... while in an intoxicated condition.

4. ... while the person's ability to operate such a motor vehicle is impaired by the use of a drug as defined in this chapter.

And if you look up the definition of "drug" it's NY's controlled substance schedules. Which doesn't seem to include nitrous oxide, caffeine, or datura/active chemicals. (Though chemicals have a lot of different fancy names I could be wrong.)

But they have the "intoxicated condition" line too so I think they could still convict you for it, just could be a harder court case. But probably not that hard if you're trying to drive on nitrous or datura.

It's about scheduled drugs. They found cracked canisters in his car, they're apparently scheduled in Texas. You wouldn't be driving on datura or Angel's trumpet.
