!commenters we must fight this assault on democracy, the right wing local paper is stopping people from buying their extremely high quality beer that definitely isn't making up for a lack of quality by plastering current year shit all over the labels
That makes it sound like they were violating a bunch of zoning ordinances which the paper reported on, so the municipal and county governments came in and cracked down. If they weren't such kitties, they could get their Killdozer on. But hey, maybe impotent, poorly-written ("legal legal"? "ehave"? Did no one proofread this?) seething will fix the situation.
his accusation that the Lakeland Times had called an official 'r-slurred'
If someone falsely accuses me of calling them an r-slur, I can get money for slander. So if I just keep constantly calling people r-slurs like I have for my entire life then eventually one will complain about it and not be able to prove it and I can sue.
They aught to win the trademark as long as it's clear it is not the product of the other brewery (ie: making the economy brew "breweryIdontlike-tier swill NOW WITH 100% LESS DOG FECES")
That's gonna be a hard sell given that the word "OPE", which is the other brewery's name, is bigger than the entire Minocqua Brewing Company logo.
I assume they're going to try to argue that "ope" is a common Midwestern word which can't be trademarked, but given the hyper-specific context in question (two Wisconsin companies in the exact same industry, one of which is using the name of the other in a product), I don't think that's gonna fly. "Apple" is a common word, that doesn't mean Microsoft can put out a product with "apple" in the name.
I'm not familiar enough with Wisconsin IP law to say exactly what the outcome will be, but at the very least, they'll have to fork over every cent in revenue they generated from selling this garbage. And that's assuming they don't somehow frick up badly enough to get slapped with a summary judgment. Given how stupid they've been about everything else, it wouldn't surprise me if they do.

Kirk Bangstad and his late wife, Elizabeth Smith, purchased the business in early 2016 from the Dan and Laurie White family who ran the business for just over 10 years.

!commenters, holy shit, it's so much worse/funnier than I expected. On top of the zoning violations, the brewery's owner lost a $750,000 defamation suit against the newspaper's owner after he falsely accused the journo of murdering his own brother. After the loss, he spent some time refusing to even show up in court, so the county tried to have him arrested. On top of all that, they're now being sued by another brewery for trademark infringement. A suit they'll probably lose since they're responding to it by laughing at the suggestion that using another Wisconsin brewery's name as the name of one of their beers is a problem.
!nonchuds aren't sending their best. Although, according to !chuds, I guess they are.
