So I looked up this lawsuit. Looks like it essentially was about to get dismissed, but the 2nd circuit has a dumbass rule that plaintiffs can amend their complaint (once) if the court grants a motion to dismiss. They filed their amended complaint and it looks like defendants are about to try and get it dismissed again.
