If it isn't understood that the renter is vacating the apartment in the near future, the landlord should have no reasonable expectation of being able to take marketing photos. Really, not even if the renter actually is vacating in the near future, unless that is explicitly specified in the contract. Should have taken marketing photos before the current renter moved in.
