The case he is talking about is abput people who were hirt when their uber crashed not being able to sue Uber directly in court because it had a "forced" arbitration agreement, where you agree that if youre suing them for sometuing having to do with the app that you agree to a certain jurisidction and special court for the ruling to be rendered. Arbitration isnt magically rigged against plaintiffs and they run by judges and theres still certain ethics, just no appeal and its cheaper. Also not all clauses in a contract are enforceable against all suers in all situations. The lawyers who draw these contracts do so to maximize liability mitigstion for their client and are often overbroad. No "release of liability" can prevent you from being sued for doing something illegal, or protect you from being sued when you personally were willfully or wontonly negligent no matter what the contract says. Hes pointing ro clauses in the contraft that havemt been successfully enforced at the end of the video. And in the begining he talks about the disney case which was dropped likely due the unenfoecebility of that clause in the contrsct and not just the bad press.

first of all "forced arbitration" is a dumb phrase when both parties agreed to it c9ntrsftually, two them not being courts doesnt make them not regulated machinations of law governed by lawyers just like courts are. Theyre just cheaper and more limited and...oh yeah you have to agree to it int he first place to be bound by them.
