Let's start with the basics. This is Undertale.

It all starts when the twitter account for the fan game named, undertale yellow

Corporate said we had to eradicate 100 tracks off our OST but on the bright side, you can now stream UTY music! πŸ€ πŸ‘

CEO interjects, while he also states that he doesn't speak for TobyFox/Royal Sciences (the actual owners) https://x.com/sebastianwolff/status/1737742943644164145

It's then shown that the game developer gave his blessing, causing the CEO to be community noted, in which he then sneeds

Now it seems that the publisher, Materia, may have retroactively FAQ on fangames https://x.com/shayy_tv/status/1738062658341916929

Funny thing is, Toby did actually make one rule:

>You can sell your covers of Undertale music, as long as you're not sampling the original songs or SFX from the game

Guess what UT Yellow did. :marseysmug:

That's rich coming from the guy whose entire musical career is composed of sampling and imitating copyrighted material

It'd be a real shame if Viacom were to copystrike his game for sampling one of their properties without their permission, real shame.

It would be really funny if Undertale got sued/dmca'd over this shit and removed permanently.

The sad part is, I think Viacom could have a legitimate good legal case if you present this evidence.

And not in a "hey these kind of sound similar" but more in a "they're complete copies of eachother"...

Afaik sampling is rarely prosecuted by large companies, but him going "nuh uh you can't sample anything from my game" when his career is made out of sampling copyrighted material and a lot of the contents of his game aren't even his (taken from media libraries) is the perfect setup for him getting hoisted by his own petard.

No one goes after sampling since so many big name rappers started heavily heavily sampling lol
