Lol the crime was โ€œmisrepresenting statements to conceal a crimeโ€ and they didn't bother charging him with any actual crime. They just argued his attempt to steal the presidency was the crime in question, and so this unrelated payment was to aid that. because the payout was somehow considered a campaign donation under NY law and so it was a crime because it was too big I guess? :marseybigbrain:

The falsifying business records isn't a crime in of itself. It's civil fraud. The crime was doing it to cover up a crime, and the actual crime is some weird esoteric NY common law recognition of stripper payments as campaign donations (or a biased court).

Supposedly the jurors were instructed that they need not agree on the crime the defendant had originally committedโ€” they just needed to believe him guilty of a crime, and that this was used to cover it up.

I'm absolutely sure it holds up in court but it's so divorced from common sense. Like the resisting arrest charges thrown at people for saying no to an unlawful arrest.

It's not, but this is New York. Apparently his lawyer listed the payments as "legal fees" rather than "reimbursements" and that becomes a few dozen felonies.

The argument is that it's because the payment was from Trumps personal funds, and since it helped him win, it should have been campaign funded. Of course, it also would have been an illegal use of campaign funds so he couldn't have done that either. You see, he's guilty because it was her turn so any action he took was illegal for denying her.

No I think they argued that because Cohen was instructed to do it by Trump, it was an illegal donation to a campaign. Like how PACs have to avoid speaking with their candidates to keep spending insane amounts of money on them.
