The falsifying business records isn't a crime in of itself. It's civil fraud. The crime was doing it to cover up a crime, and the actual crime is some weird esoteric NY common law recognition of stripper payments as campaign donations (or a biased court).
Supposedly the jurors were instructed that they need not agree on the crime the defendant had originally committedโ they just needed to believe him guilty of a crime, and that this was used to cover it up.
I'm absolutely sure it holds up in court but it's so divorced from common sense. Like the resisting arrest charges thrown at people for saying no to an unlawful arrest.
