The Constitution does not specify a time limit for states to ratify the ERA and 38 states have ratified it. The dramatic call is to assert that it is in fact the law of the land. Women will now be drafted.

It's equal s*x rights which are basically already law due to other normal laws that exist. It would only change laws in useless and unforeseeable ways. You need 38 states but at any point states can switch sides. Trying it at 38 is kind of stupid as then it will just be a culture war issue of no consequence. You can't just say things are ratified. There's a process where they take a vote multiple times and give people a chance to talk. You don't just reach 38 and yell victory. Biden is just objectively lying. Some were ratified when states were very blue in the past. They may take up arms and switch sides if such an event would take place.
