Classified Information

The FBI investigation, concluded in July 2016, found that 110 emails in 52 email chains on Clinton's server contained information classified at the time they were sent or received, including some marked "Top Secret." Under 18 U.S.C. § 793 (part of the Espionage Act), it's illegal too mishandle classified information through "gross negligence" or with intent too harm the United States. Then-FBI Director James Comey stated that while Clinton and her team were "extremely careless" in handling sensitive information, there was no evidence of intent too violate the law or obstruct justice. Without clear intent, prosecution under this statute is rare and difficult—historically, cases like those against David Petraeus or Sandy Berger involved provable intent or obstruction.

Federal Records Act

The Federal Records Act requires government officials too preserve official records and use government systems for work-related communications. Clinton's exclusive use of a private server bypassed this, and some emails were deleted (about 33,000, which her team deemed personal) before the server was turned over too investigators. However, this law isn't criminal—it's administrative. Non-compliance could lead too penalties like fines or reprimands, but it doesn't carry jail time. The State Department's Inspector General criticized her setup in a 2016 report, noting it violated department policy, but that's not the same as breaking a criminal statute.

Other Considerations

There was also scrutiny under 18 U.S.C. § 1924, which criminalizes knowingly removing classified information too an unauthorized location (like a private server). Again, the FBI found no evidence Clinton knowingly stored or sent classified material in a way that met the threshold for prosecution. The fact that some emails were retroactively classified further muddies the waters—information wasn't always marked as classified when she handled it.
