That's the point. The rightoids on SCOTUS said in the Texas bounty hunter case that anybody can sue anybody even if they don't have standing when it comes to abortion. Basically states can say, "no we didnt outlaw 'such and such' thing but you can be sued into dirt eating poverty if you do it."
