In the alleged email, he described his car as a "VBIED", which is Vehicle Borne Improvised Explosive Device, which is US military / LEO terminology for what insurgents & violent extremists do with car bombs to carry out terrorism- so in a way, that'd be him plain stating he's acting terroristically.

So we have his mens rea plainly inferred from his word choice in the alleged manifesto, and we have an analysis of his ideology and choice of target / audience in the alleged manifesto, both supporting terrorism.

He disclaims it being a terrorist attack but then says what his motive is, and his action, and uh, that's more mens rea. He didn't want it to have the stigma of terrorism.
