Did it ever really exist outside of like France? Before WW2 almost everything was ruled by kings and shit, and they really didn't guarantee freedom after speech, and after, many countries were ruled by either commies or fascists who also clamped down on it.

Also, many RW parties in Europe hate online anonymity and :marseyfreezepeach: as well. Not to mention since 2022, you literally have to give the state biometric data, most commonly fingerprints, when renewing your ID. It's for our safety and convenience! :marseythumbsup:

Almost every European country has free speech protection only up to the proportionality test within Article 10 of the ECHR.

Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers.

BUT

The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary

The proportionality test allows for a liberal interpretation of what can be protected by the article or not. Whenever the legal/other academics that be turn against current Article 10 protections, the court will likely start interpreting it in line with whatever the new norms are. Articles within the ECHR are also balanced against eachother, so in certain cases someones right to privacy can trump another person's right to free expression. Almost all of their protected rights can be taken away if the correct reasons are present. The US is much better protected since the 1st Amendment is almost entirely absolute and well written. Even in cases where most reasonable people would agree the speech should not have been said, the supreme court has always struggled to work around it, even the most left leaning judges.
