That was due to an act not an EO. EOs are directives to tell agencies how to execute federal law, they cannot create new law or violate a law.

Dole is already pretty narrow but SCOTUS have made it even more narrow when an EO is used. This case fails the doesn't violate federal law condition as SCOTUS ruled in 2020 trans is a protected status under the civil rights act.
