This is an interesting perspective ive never thought of. I wonder if we leave the commonwealth and no longer are beholden to the British monarchy if we could just rip up the treaty.
The SCC has ruled on this very issue. Their ruling was that 'treaties' between the government and indigenous bands or tribes are sui generis, that is, 'of their own kind', and therefore they are not 'treaties' in the usual sense. One sense in which they are not treaties is that they cannot be abrogated, they are un-cancelable, permanent, forever.
The elected government no longer has the authority to handle de facto matters of foreign policy about what are supposed to be other nations and is bound to the word of some king because a bunch of people dressed as Santa Claus decided a treaty isn't a treaty, this ruling counts until the sun blows out and is immune to future rulings.
