It's honestly wild that the president has the power to unilaterally enact tariffs at will. Seems like something that would go through Congress.

Well Congress is too busy trading stocks and talking to the media, so the President and Supreme Court have to do the heavy lifting.

It would be up to Congress to take him to court over this issue. I'm really hoping that happens because it would be fricking lit.

Taxes are an enumerated power of congress. Congress gave POTUS three ways to enact tarrifs without him; go though DOC which takes about a year, USTR which takes about a year and declare war on them.

The legal theory the Trump camp has advanced is that the part of USC which allows him to sanction countries also allows him to tariff countries. Courts told him it doesn't last time.

So, during his first term he enacted plenty if tariffs. Did the hostile Legislative branch approve them? At the end of his term, pretty much all of them were enacted. Then Biden came along and didn't rescind the EO on them, so they're still in place.
