People's identity is not for anyone else to decide but them and trans people are who they say they are regardless of if they "pass", regardless of if they use medication or surgery, they are who they say they are, period.

A socially constructed concept like gender absolutely requires buy-in from the society, by definition.

The fact that society has an imperfect understanding of s*x and gender doesn't change that, though it is unfortunate.
