There was no baby. A nonviable sack of parasitic cells with no cognitive ability, had βtraces β of meth and there is no proof that the meth caused the miscarriage.
Correct.
So if someone punches a random woman in the stomach on the street as opposed to a pregnant woman, killing her baby, same punishment? No issues there whatsoever since it's a clump of cells?
Ummm. It's a parasite/measly clump of cells sweaty.
I do not agree with what happened to her, but there's a big caveat here. The reason why she was prosecuted was because she was using methamphetamines and the fetus tested positive for methamphetamines. That being said, there was no concrete evidence that the methamphetamines were the cause of the miscarriage. Still, I feel this context is important and necessary. It's not as though she was prosecuted simply because she had a miscarriage.
Correct. A moderate amount of meth use might actually be beneficial for a fetus.
The fact the American justice system thinks this is acceptable to convict a woman for a miscarriage is inexcusable.
Please learn to read. "After admitting to methamphetamine and marijuana use during pregnancy, trace quantities of these substances were found in the foetus' brain and liver on post-mortem."
There is no context that makes charging a woman who had a miscarriage with murder of her fetus OK.
Yes there is. This is one.
A fetus is not a person, therefore, cannot be manslaughtered or murdered. Religious zealots are the worst kind of people.
The absolute worst.
