Free market isn't very good at pricing in long term effects that are not very well understood. Hiring pajeets because they are half as productive but five times cheaper doesn't take into account technical debt they create on multiple levels and can lead to the boeingification of the entire industry.

You can't trust the free market to pressure a publicly traded company to act responsibly when there's an opportunity to cut costs now but maybe shit the bed 5-10 years later, when all real talent has left and technical debt became unmaintainable. And you should be especially worried when this is a result of a global regulatory change, with stockholders asking the CEO: "everyone is hiring pajeets now, why aren't you hiring pajeets?"

And this context (h1b hiring) is a particularly spectacularly bad example to justify regulation, because you have obvious motivated reasoning from morons explaining why tech companies can't actually be trusted to hire employees properly. If a DEI grifter said that not having your 15% of your SWEs be obese black lesbians represented a "market failure" we would treat these words as some sort of magical argument-winning bullet, we would instead realize that this was just a convenient excuse from someone who doesn't actually have a vested interest in the success of the organizations that they're prescribing advice to.

No, development of healthcare.gov was a market failure. Countless horror stories from the trenches represent market failures. It's not comparable to your strained analogy, when someone complains that 15% of coworkers are pajeets now which is bad because, it just is, okay? It's people complaining that cleaning shit up after pajeets takes more effort than if they wrote it themselves in the first place.
Then, we know that imperfect information is like the textbook cause of market failures https://en.wikipedia.org/wiki/The_Market_for_Lemons and so on, and we can observe it at work here: ordinary programmers can grumble about pajeets over a beer all they want, but they won't do that where the upper management can overhear them, so the CEOs don't know, the stockholders don't know, nobody tells them because nobody wants to be called a racist and blacklisted from the industry.
So for example we have this funny situation right here, with all the shit that is being flung at Elon, somehow nobody says in the open that pajeet programmers suck. The elephant in the room is completely unmentioned. Your counter-argument, that firms are perfectly capable of taking into account long term effects of incompetent programmers, is your own invention because you have never seen it in the wild because nobody has called pajeet incompetence out in the first place.
So yeah, I'm not very optimistic.
