No it's not. Being in the US without status is not a crime otherwise criminal protections would kick in when they are detained, making it administrative rather than criminal is why they don't have automatic right to counsel and why they can be detained indefinitely without a hearing.

I knew someone who got stuck on green card for decade or two because he can't stop getting caught for DUI.
Some people just have poor self-control, that they can't even stay on good behavior until they are in the clear.

For comparison, if you have a DUI on your record, you are literally banned from Canada. Like you can't even go there as a tourist to travel.

Isn't it usually the case that you have to frick up multiple times or pretty severely to have an actual DUI on your record? I've heard there are like a million diversion and delayed prosecution programs.

Yeah they usually get pled down to a wet and reckless or reckless driving on the first offense, or there's diversion programs where you go to a shitload if classes and they get expunged but it's expensive. There are usually Vet courts that do the same for combat vets who frick up. Usually with a Judge that was in the military, too. One judge sentenced a vet to a night in jail for noncompliance and then showed up that night to spend the night with him since the guy had PTSD.

When I was younger, a close friend of mine was on a work visa for a ridiculously long time (like 10-12 years) just because of dumb lawyers making mistakes with his paperwork and the ordinary incompetence and glacial speed of the federal government. He used to drink and drive all the time. I kept warning him they were going to kick him out of the country if he got a DUI but he never got caught so who the frick knows.

/unjerk but the problem is the rslurred US law system where a thousand things are illegal but under the disgression of the police and DAs to actually enforce it. There are even hundreds of city ordinances, or even state laws, that are blatantly unconstitutional but would require a challenge in a higher court system (e.g. the r-sluro state judge that convicted Trump)
