A legal precedent about emulation was set back during Sony vs. Connectix. You're allowed to compete with console sales, so long as you're not facilating piracy. Which Yuzu certainly was.

If you read the court doc, you would know that none of the yuzu source can be used anymore by anyone without violating the judgement.

No one cares because the emulator is 99% perfect. Like metroid dread had zero issues upon launch. Mario wonder only needed like 2 minor tweaks to run perfectly etc. Worst case scenario some nerds fix issues based on late builds that already exist.
