They weren't profiting off of it and you need a legal copy to run the mod (although that's never stopped any lawyer )
Activision reportedly knew about the project for years
The series was on sale just a day prior to this
As with cease and desist orders, they can't distribute the mod in any legal way now

I mean it serves to provide a notice date for any applicable damages calculation in some cases, but that's only if they actually sue after a C&D.
I would expect Activision to follow up with an actual suit given their track record.

I imagine getting significant costs is an uphill battle without sending one. Mind you, I've seen plenty of bad legal threats be used against the party that sent them for costs. Those vague bullshit letters that don't really say what you're doing wrong and how that hurts them and what law it breaks.

Depends a lot on the case type I find. My firm's largest patent award came from a situation where we just sued instead of sending a C&D since damages accrue by use and we didn't want a latches defense

Cease and desist letters for copyright infringement can impact both liability and damages, and will impact costs awards (making the loser pay for some of your legal fees).
Some statutes require intentional infringement, or it can broaden damages. A proper letter is great evidence if they continue.
Many jurisdictions, including my own, drastically limit what your can get for costs if you don't take reasonable steps before suing.
