Removals are a legal process with very limited ability for POTUS to do anything about. There are 600 immigration judges in the entire country, last year they cleared just north of 1m cases with 1.6m new cases. Congress have refused to add more money to the system for the last decade. It takes 3 years to get a removal order, anyone who has already claimed asylum is here for 11 years.

Immigration detention is at capacity. Congress isn't going to give him the $1t a year it would cost to detain them all.

The things you mention dont apply to all OR most of the illegals here tho. He could still order a large portion to be deported and local and federal law enforcement to participate. He is head of the executory branch afterall.

The only people who are removable without a removal order are those who have been in the US for less than two years, who didn't come though an official border crossing and have not petitioned USCIS. Due to the Biden app that is not very many people.

Only 40% succeed in asylum applications but they get a decade here even if they fail.

Unless they are going to Mexico or the EU they also need the government they are a citizen of to help. That's why there have been no deportations to Venezuela in a year, they are no longer accepting deportees.

He didn't understand this last time either which is why removals fell. USCIS, DHS legal and CBP have limited resources which are set by congress. The more he tries to frick with how they work the less people they can deport. Last time he added a whole lot of additional restrictions to legal immigration that monopolized USCIS resources.

DHS legal is dropping about 200k immigration cases a year right now because they don't have budget to hire more lawyers to represent the government in legal proceedings. I expect the number to increase over his term even if no more people come in.

congress are a majority republicans, they can give him/DHS and ICE the resources/funding and legislation they need. He didnt have that in his first term which is the real reason he failed to deport as many people as he wanted first term. FDR did a good job too. He put the japs in concentration camps and deported the hard-working Americans.

The legal reality of $CurrentYear is very different to the 50's. Even with a stacked SCOTUS I don't see them backing out the last 75 years of decisions on 4th, 5th, 6th and 14th protections that would prevent a roundup even if congress gives him money and passes laws allowing him to deport everyone.

barely, he hardly had control of the denate and he had a lot of rhinos and old timer republicans opposing him and he hadnt taken over SCOTUS yet

also when were FDRs concentration camps or Eisenhaurs deportations deemed unconstitutional? Pretty sure SCOTUS ruled in favor of it at least with the camps

Because they sign up for TPS and become undeportable, meaning its a literal waste of their time to even go to trial because they can either lose or get stalemated because you cant enforce the order you won. You dont even need the prosecutor to agree anymore, new rules allow lolyers to just ask the judge to close a case if your client has TPS.
