Some of the moral issues here don't even make any sense - one can agree for example, that simply declaring yourself a woman should not get you sent to a female prison, that's a rational stance to hold and most people probably agree with that outside of the most extreme of wokies.

where it becomes more nuanced is what exactly are we to do in the case of an actual long-time trans woman that presents and identifies as a woman? should we send them to a male prison? can the government guarantee their safety? No shot they can.

so what are we deciding here? some trans woman convicted of some random crime should be sent to a male prison to be r*ped and murdered?

as is the case with most rightoid positions, they have a very surface level understanding of an issue and apply a very surface level solution to whatever problem they believe exists. I've been trying to explain for ages why rightoids are way more dangerous than leftoids - with leftoids their most absurd positions aren't taken seriously and are never an actual threat. with absurd rightoid positions through the power of performative common sense face less resistance from the median voter.

As rational people we can agree that some guy shouldn't be allowed to declare himself a woman after being arrested to be sent to a softer prison - but you're never gonna convince me we should be sending actual trans women to male prisons under the guise of protecting women or whatever, it's a cruel and laughable position to hold, and most of society would probably agree if they had a more nuanced understanding of the topic.

if rightoid performative common sense won out historically we'd still have lead in our gas and we'd still be using asbestos.

I was under the impression that:

• Legislation is welcome to define terms for the purpose of the legislation itself.

• More often, courts end up defining terms as part of case law.

It would be a crisis of separation of powers if an EO could redefine terms arbitrarily.
