What you have read is incorrect.
He was separately charged with murder for hire out of MD. The feds do this all the time with unusual cases so they have a backup if the primary case fails. They dropped the 2nd case after he was convicted.
They didn't disclose most of the murder for hire evidence during the drug trafficking case. That is SOP for dual charging.
No idea if he actually did or not but the claims the charges are BS because they had weak evidence during the trafficking trail and that they didn't charge him with it are nonsense. They didn't know if a jury would bite the unusual case so kept that as a backup.

I did a deep dive on this before the 2020 election when a bunch of the dem primary candidates were making noise about it and my takeaway was something along the lines of: congress set up the original list of controlled drugs (The Controlled Substances Act) and has the ability to make changes to the list. The executive branch also has the ability to modify the list via recommendations of the AG/head of health and human services/DEA, but this ability was originally conceived to cover new novel substances that congress doesn't have time to research and were not in the original list. In practice this ability is (exclusively?) exercised by the DEA for banning new drugs/research chemicals whenever they get a little too popular.
Executive branch rescheduling stuff that's already on the list as a result of congressional action is a bit of a gray area and afaik has never been done before but may be possible depending on how the courts feel about it.
