In most cases, it doesn't matter. Being in the car with the keys in your possession is enough to get a OWI, even if the vehicle isn't running.
Since Teslas can use your phone as a key and is always in a "ready" state, it's super easy to get a OWI -- doesn't matter if you're just sleeping it off.
