:marseyakshually: the Senate had a trial and voted to not convict. Juries (or Senators in this case) don't actually make determinations of truth. That's why jury nullification is a thing.

They can't convict. It's not a criminal trial but quasi-trial. There is no conviction in criminal law sense but simply determination of validity of the impeachment charges . House sets the charges and senate determines if they are valid.

You're telling me that you think senators voted on their evaluation of the merits rather than to affirm/nullify based on their desired outcome?

It's obvious that Republicans voted to nullify, just as Democrats have in the past. It was a 99% party-line vote.

"Jury nullification" is simply the sense that "I'm voting on charges, and nobody can do anything about how I vote. So, I can nuke charges that are valid just because I want that outcome."

You'd have to be a rube to not understand how that concept is applicable to a "jury" of senators.

There is still no jury. All the Senate needs to do is try the charges with a vote. So senate pretty much says is if impeachment was guilty or not and that is final. It is like that because House can allege what ever it wants.

Because House sets the allegations while Senate pretty much confirms allegations be true or false.

Yes, I understand the process. I'm saying the same theory of jury nullification applies: if the people voting on the charges don't want them to stick, no merit to the accusations can force another outcome.

The Republicans had enough votes to nullify the impeachment charges against Trump, and they did. This tells us little to nothing about the merits of the charges, just as if a jury decided to nullify.
