The EU is based about it actually. If your Eula contains non standard shit in the EU it's just straight up invalid, the EU doesn't actually expect people to read Eulas.

Iirc it's because you have already purchased it before they spring it on you. It's changing the contract after it is signed. They would have to make you read the eula before you buy the game if they want to include non-standard conditions.
Imagine buying groceries, and when you get home and open them they tell you that you're only allowed to use these ingredients for vegan dishes.

I use "commie" as a standin for regulation-enjoyer (I am thoroughly colonized, working on it). In Europe we have very strong factions of voters who want to solve everything via state intervention and I am inclined to believe economists when they say that this is at least partially what lead to us becoming so poor compared to US
