This has been an issue in the industry for a long time, but I noticed there's been quite a few more posts about this in just the last few weeks. OnlyThots are talking about rising up and switching to Fansly because they say they have better protection against chargebacks.
I recommend clicking over to some of these posts and then randomly clicking accounts to get eyes on these ladies. It's generally quite bleak.

Probably. It's not like reporting a card stolen results in an actual criminal investigation, they just "reverse" the charges and give you a new card. I guess if you do it multiple times on the same card they'll tell you to frick off but I bet you could use a few different banks without issue.

That's pretty much all you have to do. File a chargeback with the bank. The bank will investigate, but it's always an auto-win if you claim that your card was stolen and it's a fraudulent charge. It also depends on the bank but you have certain consumer rights that kick in too. Some cards are easier than others. Like American Express is very consumer friendly and will issue a chargeback easily to the vendor, but that's also why the merchant pays an extra percent to American Express and why some smaller shops won't take it.

yeah you will basically win a chargeback regardless of reason with amex, and it's why some people won't take it. There is a process where the vendor can fight a chargeback and sometimes they win but not with amex!

Yeah I think they're literally legally forced to take the loss if you report it as fraudulent/stolen. They could hypothetically build a case against you (like if you somehow bought a car on credit, issued a chargeback claiming it was fraudulent, but they dug up records that you registered the car in your name or something). But for this kind of thing there's no real way for them to do that so the bank actually has no recourse. The most they'll do is decline to issue you a new card and instead close your account, but they can't charge you for it, only prevent you from stealing more.

If you bought a large purchase, I would assume then it would fall to the legal system where there would be a lawsuit. It's the small chargebacks that are the major issues. Not enough for a lawsuit and it would only be worth pursuing it if it's tens of thousands of dollars in non-payment. I know of someone who had a $10k non-payment in a different state and her attorney told her that it still isnt worth it even for small claims.

I've used Stripe and if you can prove that you provided the goods/service then you don't lose money with the chargeback. OF must have something similar since otherwise it would surely be too easy to game, especially for a porn site where people are going to be 'omg someone stole my card number' when their wives find the bank statements and so on. Maybe these foids are running some subscription where they never actually upload videos and thus don't have any proof they actually sold anything?

That is not true, there is a chargeback re-presentment and arbitration process that merchants have a right to through the networks (Visa, MC, etc) wherein they submit evidence to contest the chargeback. Not every chargeback is successful, but most of them are. There are also occasions where the chargeback fails, but the card issuer pays out anyway… issuers generally don’t tell you when this happens

It seems you didn’t read or possibly comprehend my entire comment. There are a lot of nuances to this, but in essence the merchant has the opportunity to prove that goods were in fact shipped/rendered to the actual customer. Claims with such evidence can be decided in favor of the merchant, in which case the issuing bank can be held liable. At that point, the issuing bank can choose to either eat the loss or re-bill the customer. Some banks will just eat the loss if it’s not a large amount basically for the sake of not annoying their customer or causing an escalation/complaint. Amex is a big example of this, but many large card issuers do the same thing (this is also why people seem to think, even in this thread, that Amex wins every chargeback… they don’t)

Sure, but in this case the argument isn't "OnlyFans didn't deliver the content I paid for", but rather "someone stole my credit card and fraudulently used it to make these purchases". OnlyFans can prove that they delivered what you paid for but that doesn't really matter. I suppose the bank might eat it then because the merchant is clearly not at fault. I'm also quite certain it is illegal for them to re-bill the customer in this scenario, as part of reg z. Unless of course they or OF can prove that the person who made the account and purchases on OnlyFans was in fact you, but that's much harder to prove and easy to sidestep if you're abusing the system.

I replied to your comment about Stripe, OnlyFans is another story… you’re correct that it’s likely they won’t be able to provide evidence proving anything about the customer. Under Reg E and Reg Z banks have to provide provisional credit in a timely manner, but they are still entitled to an investigations process… it is not “illegal” to re-bill a customer for a claim the bank chooses to deny (nor is it illegal to re-bill if the network decides in favor of the merchant), but it can result in a CFPB complaint/investigation so the burden of proof is generally high.
