Well the idea is they shouldn't have been storing a victims DNA in a criminal database to begin with. It's a pretty unique circumstance that they took advantage of. Victims of almost any other crime- like assault or robbery- are not required to provide a DNA sample to get the police to investigate their case. Hypothetically, although I doubt it, if the courts were to side with the cops we could see a future where everybody who reports a crime for an investigation would be required to provide a DNA sample which will then be logged indefinitely into their database. This could come back to haunt you in the event that a close relative commits a crime or if they get a partial sample from a crime scene that is close enough to yours that they could pin a case on you. Not to mention general privacy issues and the possibility to sell the information under the right circumstances.

That's the point. They aren't required to give it, the cops took the r*pe victims DNA and added to their criminal database just because they had access to it. I'm not talking about just this specific person, they've done this with all the r*pe kits they've processed. If the courts were to decide that this is ok, then that would mean technically it would be legally ok to do this with victims of any kind of crime that they investigate. For example, if someone were to stab you and they took the knife for evidence, your DNA would now be added to a criminal database. You haven't done anything wrong, but your DNA is going to be in the database with the DNA of actual criminals and will be a part of every search they run in the future.

Just because law enforcement acquires something does not mean that they are permitted to use it in a case or keep it indefinitely. Evidence for closed cases are to be returned to the victim or destroyed after a certain period of time. Let’s say your wedding ring got stolen during that stabbing. They don’t keep that ring forever once it’s been found. They have to return it to you at some point. If you give the cops your phone to pull text messages for a case that doesn’t mean that they now have free access to your bank account as well just because you have the banks app on your phone too.

Your example is completely different from the situation being discussed. If a mugger comes to the police and says he mugged a guy but that he believes the property stolen proves that the victim might be a serial killer, law enforcement could then open a separate investigation into the victim if they so choose. What he turns in could possibly be used as probable cause for a search warrant but later not be admitted into evidence for the trail due to the nature of how it was acquired.

Homicide cases are unique when compared to other crimes. Even when they’re β€œclosed”, they’re open due to their nature. There is also no victim to return the belongings to because they are deceased, and victim’s rights are also regarded as a general non-issue because there is no longer a victim to protect. And DNA isn’t really used as probably cause for things because you typically you need the warrant to get the DNA. That’s what makes a circumstance like this so unusual and potentially troubling for future cases. Think about how much hair the average person sheds in a day. In almost any place a person goes there’s a chance they could leave a trace of themselves there and any place could be the scene of a potential crime in the future. Witness descriptions can be vague and security cam footage isn’t always clear. If we live in a world where you can run a blanket search on anybody’s DNA without probable cause you better hope you don’t vaguely meet a perps description and have happened to shed a hair at the crime scene location some point. Without a solid alibi for the time of the events, you could be in serious trouble. Juries like DNA evidence, even if the rest of the case is very weak. If we get to a point where traditional case building can be skipped and prosecutors can just lean on circumstantial DNA evidence, it could potentially be very easy to get juries to convict innocent people.

Since you don’t see the legal implications of this, I guess you see it as more of a non-right to privacy issues. I suppose you’re the type that believe that DNA samples should be taken when issuing birth certificates because as long as you never do anything wrong you never have anything to worry about. I disagree. I believe that our genetic information is the most personal information possible and that it should be safeguarded just as much, if not more, than anything else private in our lives. I do not believe that if you become a victim of a crime that your right to your genetic information should now be considered forfeit. But you’re free to have your own views about privacy.

Honestly, unless it's a crime of the utmost severity, yeah. You're going to cause a chilling effect on report rates, and outrage the public even further. You can't chase down every crime, and sexual assault is a very serious crime. You want that to be reported, and don't want to make people fear reporting it. They already do.
